Witnesses reportedly indicated she may have been talking on her cell phone at the time.
Felix Coss, 61, was pronounced dead at Bellevue Hospital after being hit by the van crossing Broadway Avenue in the Williamsburg neighborhood at about 4:30 p.m. Saturday.
The middle school Spanish teacher was crossing from the south side to the north side of Broadway when he was hit by the van, which was turning onto Broadway from Hooper Street.
Officer Paula Medrano reportedly refused to hand over her cell phone to investigators, who then issued a subpoena.
Coss had a green light and was in the crosswalk when he was struck.
"It definitely didn't look like it was his fault," said an eyewitness, who declined to be identified. "It appeared that he was crossing the street, mostly likely had the right of way. The cop did not yield and hit him."
At this point, Medrano has not been charged.
