Buildings Commissioner Robert LiMandri said the operator, Paul Geer, was lifting twice the weight capacity of the crane.
Geer was lifting a load of lumber that weighed 23,900 pounds when the crane collapsed.
A Stop Work order at the construction site remains in effect while the investigation continues.
Seven construction workers were injured when the crane collapsed, three seriously. One remains hospitalized at NY-Presbyterian Weill Cornell Medical Center.
