Woman sues Haverstraw over false arrest

May 25, 2012 3:29:44 PM PDT
A woman from Rockland County is suing the town of Haverstraw for more than a million dollars. She was charged with driving drunk and held for several hours in jail, but the charges were dropped after video surfaced proving she was not the driver.

The surveillance video is plain to see. A white car pulls up to a gas station and a male driver gets out. Dayna Lynch exits from the passenger side, but just a short time later police arrest her for DWI.

The incident happened in May 2010 at a Shell station in West Haverstraw. Police came upon Lynch, her friends in the car, and some other individuals hanging out. There was no emergency call, but the group was questioned by police. One man was briefly handcuffed.

Lynch spent 5 hours in jail before being released. Even after the video exonerating her surfaced, it took 3 months to have the criminal charge against her dropped.

Lynch is suing in federal court for 1.5 million dollars. The town has offered to pay 15-thousand. Settlement talks continue.

Attorneys for the town of Haverstraw had no comment.
