The family of Kenneth Chamblerlain Sr. says they want to make sure what happened to him is not forgotten.
This is a case Eyewitness News investigators have been following.
The elderly Marine veteran's family is calling for accountability and transparency.
They held a press conference Sunday afternoon at a church in Harlem.
They say they're disappointed and hurt White Plains city leaders haven't stepped up and joined them.
Kenneth Chamberlain Jr. says he won't mourn his father's death until his family gets justice.
"Why were you responding to a medical emergency and end up killing my father?," said Chamberlain.
Kenneth Chamberlain Sr. was shot and killed by police as they responded to his apartment last November.
The 68 year old's medical alert device recorded the entire hour-long stand-off.
"He asked, 'Please leave me alone'", said family attorney Mayo Bartlett. "I'm a 68 year old man."
"The response from law enforcement was, we don't give a __ and then they called him the n-word."
As my colleague Jim Hoffer first reported, court documents identify the man on the tape using that racial slur as White Plains police officer Steven Hart.
Hart is also fighting allegations of police brutality in a civil lawsuit by a man who says Hart used excessive force when arresting him for disorderly conduct outside this bar.
"He grabbed me from behind and pushed me to ground, smashing my face in ground 4 times," said the plaintiff, Edgar Maurad. "All I said is I didn't do anything."
Court documents show officer Hart denies all allegations of excessive force.
Officer Anthony Carelli, who fired the shots that killed Chamberlain, is also facing brutality allegations in a 2008 civil lawsuit.
In this new investigation, police maintain Chamberlain threatened them with a knife.
But his family insists police had no reason to shoot their father.
"It felt like it would be swept under the rug," said Chamberlain. "But my family and I we prayed on it. Finally it seems as if people are paying attention. They're saying enough is enough."
