George Villanueva is accused of pushing Officer Alain Schaberger over a railing when the officer responded to the scene.
In the 84th Precinct, the streets are being patrolled by officers from other areas as members mourn one of their own. Meanwhile, prosecutors offered no leniency to the suspect.
Villanueva, 42, ducked cameras as he was led to court, but he could not dodge a first-degree murder charge. Police say Villanueva shoved the 42-year-old Schaberger over the railing in Boerum Hill, sending him plunging down a concrete stairwell to his death nine feet below.
"They had one handcuff on his wrist when he pushed Officer Shaberger with both hands over the railing," NYPD Commissioner Ray Kelly said.
Investigators say Schaberger landed on his head and broke his neck. Schaberger and fellow officers were responding to the home of Villanueva's girlfriend, after she called 911 saying he was trying to kill her.
Other officers on scene had to use a taser to subdue Villanueva. Schaberger was a 10-year veteran and was also a Navy vet who was engaged to be married.
